Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Anime Art AI ("the Service", "we", "us", "our"), you ("User", "you", "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not create an account or use the Service. These Terms constitute a legally binding agreement between you and the Service operator.

2. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into this agreement, and are not barred from using the Service under the laws of your jurisdiction. We reserve the right to request proof of age at any time and to terminate accounts that violate this requirement.

3. Account Registration & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to immediately notify us of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account. You may not share, sell, or transfer your account to another person.

4. Prohibited Content — Zero Tolerance Policy

The following content is strictly prohibited. Any attempt to generate such content may result in immediate and permanent account termination without notice or refund:

• Child Sexual Abuse Material (CSAM): Any content depicting, suggesting, or requesting sexual content involving minors (real or fictional) is strictly prohibited under the PROTECT Act (18 U.S.C. § 1466A), 18 U.S.C. § 2256, and applicable international laws including the EU Directive 2011/93/EU. This includes but is not limited to: lolicon, shotacon, or any depiction of characters explicitly or implicitly described as minors in sexual, nude, or suggestive situations.
• Snuff / extreme violence: Content depicting murder, torture, or death for sexual gratification or entertainment purposes.
• Bestiality / zoophilia: Sexual content involving animals.
• Non-consensual intimate imagery: Real-person deepfakes, revenge pornography, or any non-consensual intimate imagery of identifiable individuals.
• Content promoting illegal activity: Content that promotes, glorifies, or facilitates human trafficking, terrorism, or any other criminal activity.

This list is non-exhaustive. We reserve the right to determine, at our sole discretion, what constitutes prohibited content and to update this list at any time.

5. Content Moderation & Monitoring

All prompts submitted to the Service are processed through automated content moderation systems before any image generation occurs. We maintain comprehensive audit logs of all generation requests — including blocked, modified, and approved prompts — as required by our payment processors and applicable regulatory frameworks.

By using the Service, you acknowledge and consent to the monitoring, logging, and review of your prompts and generation activity for compliance, safety, and legal purposes. These logs may be reviewed by authorized personnel and may be provided to regulatory bodies, payment processors, or law enforcement as required.

6. Account Suspension & Termination

We reserve the right to suspend, restrict, or permanently terminate your account at any time, for any reason, at our sole discretion, with or without prior notice. Reasons for account action include, but are not limited to:

• Any attempt to generate prohibited content as described in Section 4.
• Circumventing or attempting to circumvent content moderation systems.
• Abusive behavior, harassment, or threats directed at the Service or its users.
• Violations of any provision of these Terms.
• Activity that exposes the Service to legal liability or reputational harm.
• Using the Service for unauthorized commercial purposes, scraping, or automated abuse.

Suspended or terminated accounts lose access to all Service features. Credit balances in suspended or terminated accounts are forfeited and are not eligible for refund.

Violation data — including user identity, IP addresses, email addresses, and attempted prompts — may be retained indefinitely for compliance purposes and may be reported to relevant law enforcement authorities as required or permitted by applicable law.

7. Privacy & Data Protection

We are committed to protecting your privacy. The following principles govern our data practices:

• We do not sell your personal information. Your data will never be sold, rented, or traded to third parties for marketing or commercial purposes.
• Data use is limited to service operations. Your personal data (email, IP address, generation history) is used exclusively for: providing the Service, processing payments, compliance and audit purposes, abuse prevention, and responding to legal requests.
• Audit and compliance logs are maintained as required by payment processor regulations and applicable laws. These logs include prompts, moderation decisions, and associated user identifiers.
• Generated images are stored in private cloud storage accessible only to you via authenticated, time-limited signed URLs. We do not publish, share, or display your generated images without your explicit action (e.g., sharing features you initiate).
• Third-party processors. We use third-party services for payment processing (Stripe, PayPal), cloud infrastructure (Cloudflare, Neon, Upstash), and AI model hosting (RunPod). These providers process data only as necessary to deliver their services and are bound by their own privacy policies.
• Data retention. Account data is retained for the lifetime of your account. Moderation and compliance logs may be retained indefinitely as required by law. You may request deletion of your account data by contacting support, subject to legal retention obligations.

8. Intellectual Property & Generated Content

Images generated through the Service are created by artificial intelligence models and are provided "as-is". Subject to your compliance with these Terms:

• You retain usage rights to images you generate for personal and commercial purposes, provided such use does not violate these Terms or applicable law.
• We make no representations regarding the copyrightability of AI-generated content under your jurisdiction. Legal status of AI-generated works varies by country.
• The Service retains the right to use anonymized, aggregated, non-identifiable data for system improvement, safety research, and statistical analysis.
• You may not claim that AI-generated images were created by a human artist, or use them to infringe upon the intellectual property rights of others.

9. Credits, Payments & Refunds

The Service operates on a credit-based system. The following terms apply to all transactions:

• Purchased credits are non-refundable except in cases of verified Service failure where generation was not completed and credits were not automatically refunded.
• Credits have no cash value, cannot be transferred, and cannot be exchanged for currency.
• Free daily credits expire at the end of each reset period and do not accumulate.
• Pricing, credit packages, and conversion rates are subject to change. Existing purchased credits are not affected by price changes.
• Chargebacks or fraudulent payment disputes may result in immediate account termination.
• Suspended or terminated accounts forfeit all remaining credit balances without compensation.

10. Acceptable Use Policy

In addition to the prohibited content rules in Section 4, you agree not to:

• Use the Service to generate spam, misleading content, or for phishing purposes.
• Attempt to reverse-engineer, decompile, or extract the AI models used by the Service.
• Use automated tools, bots, or scripts to access the Service beyond authorized API usage.
• Circumvent rate limits, content filters, or other technical restrictions.
• Share your account credentials or API keys with unauthorized third parties.
• Use the Service in any manner that could damage, disable, or impair our infrastructure.
• Resell, redistribute, or sublicense access to the Service without written authorization.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless the Service and its operators, affiliates, officers, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service, (b) content you generate or distribute, (c) your violation of these Terms, or (d) your violation of any third-party rights or applicable law.

14. Law Enforcement Cooperation

We cooperate fully with law enforcement agencies and regulatory bodies investigating illegal content or criminal activity. We may disclose user information, generation logs, IP addresses, payment data, and related records in response to valid legal process (subpoenas, court orders, warrants) or when we believe in good faith that disclosure is necessary to: (a) comply with applicable law, (b) protect the safety of any person, (c) prevent fraud or abuse, or (d) protect our legal rights.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration, except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration against the Service.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Changes to Terms

We may update these Terms at any time by posting the revised version on this page with an updated "Last updated" date. Material changes will be communicated via email or prominent in-app notification at least 14 days before taking effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.
